Introduction

OptiProq ('we', 'us', 'our') takes the protection of your personal data seriously. This privacy policy explains which personal data we collect when you use our website and contact us, the purposes for which we use it, and the rights you have under the General Data Protection Regulation (GDPR) and the Dutch Implementation Act (UAVG).

What Data We Collect

When you submit our contact form, we collect the following personal data:

  • Your name
  • Your e-mail address
  • Your company name (optional)
  • The content of your message

How We Use Your Data

We use your personal data for the following purposes:

  • To respond to your enquiry and provide the information or service you requested.
  • To assess whether and how our services may be relevant to you or your organisation.
  • To send you relevant updates, insights, and marketing communications about our services, only where you have given your explicit consent via the form checkbox.
  • To improve our website and communications on the basis of your feedback.

Legal Basis for Processing

We process your data on two legal bases under Article 6 GDPR: (1) Legitimate interest (Art. 6(1)(f)): to respond to your enquiry and maintain a record of our business contacts; and (2) Consent (Art. 6(1)(a)): for marketing communications, which you provide by ticking the checkbox in the contact form. You may withdraw your consent at any time (see 'Your Rights' below).

Data Retention

We retain your contact data for a maximum of two years after your last interaction with us, unless a longer retention period is required by law or you request earlier deletion. Contact form submissions are stored in Formspree for a maximum of 30 days before being transferred to our internal systems.

Third Parties and Data Processors

We share your data only where strictly necessary for the purposes described above:

  • Formspree - Our contact form is processed by Formspree, Inc. (USA). Formspree acts as a data processor on our behalf under a Data Processing Agreement. Data transfers to the USA are protected by Standard Contractual Clauses (SCCs) as approved by the European Commission. Formspree's privacy policy is available at formspree.io/legal/privacy-policy.

Your Rights

Under the GDPR and UAVG, you have the following rights with respect to your personal data:

  • Right of access: you may request a copy of the data we hold about you.
  • Right to rectification: you may ask us to correct inaccurate or incomplete data.
  • Right to erasure ('right to be forgotten'): you may ask us to delete your data, subject to legal retention obligations.
  • Right to restriction of processing: you may ask us to restrict how we use your data in certain circumstances.
  • Right to data portability: you may request your data in a commonly used, machine-readable format.
  • Right to object: you may object to processing based on legitimate interest.
  • Right to withdraw consent: where processing is based on your consent, you may withdraw it at any time without affecting the lawfulness of processing before withdrawal.

Complaints
